Services

• Gibbor Connect provides NFC and QR products, hosted digital profiles, profile links, QR codes, vCard downloads, internal production tools, and related support.
• Some services are provided through third parties, including ecommerce and payment (Shopify), hosting, database, image storage (Cloudinary), email delivery (Resend), analytics (PostHog), print, and shipping providers.

Orders and production

• Product descriptions, pricing, lead times, and availability may change.
• We currently sell and ship physical products to customers in the United States and Canada. Hosted digital profiles can be viewed by visitors anywhere.
• Custom cards, printed materials, programmed NFC products, and personalized designs may not be refundable once production has started, except where required by law or stated in a separate return policy.
• We may refuse or cancel orders if information is incomplete, payment fails, fraud is suspected, production is not feasible, or the order violates these terms.

Profiles, NFC, QR, and vCards

• A Gibbor Connect card or QR code points to a hosted profile URL. NFC chips should store only the public URL, not personal information.
• You represent and warrant that you own or have obtained every license, consent, permission, and release needed for the information, names, likenesses, trademarks, logos, files, images, artwork, icons, links, and other content you provide, including copyright, trademark, privacy, and publicity rights.
• You remain responsible for your content and for paying any license, royalty, talent, photographer, designer, stock-media, trademark, or other fee connected to it.
• You grant Gibbor Connect a worldwide, non-exclusive, royalty-free license to host, process, cache, resize, crop, reproduce, display, and transmit content you provide only as needed to operate profiles, prepare artwork, fulfill orders, provide support, investigate complaints, and protect the service. This license ends when the content is deleted, subject to backups and legal retention.
• Public profile content may be viewed by anyone with the profile link, QR code, or NFC card unless the product offers and enables a more limited access mode.
• vCard downloads are generated from profile data. Visitors decide whether to save that contact information on their own devices.

Acceptable use

• Do not use Gibbor Connect to publish unlawful, deceptive, infringing, abusive, harassing, obscene, malicious, or harmful content.
• Do not upload stock media, photographs, logos, artwork, music-related imagery, celebrity or private-person likenesses, or other content unless your license or permission covers this hosted and public commercial use.
• Do not use profiles, QR codes, links, uploads, or cards for phishing, impersonation, spam, malware distribution, illegal goods or services, sexual exploitation, nonconsensual intimate imagery or deepfakes, hate, harassment, or privacy-invasive activity.
• Do not attempt to interfere with the service, bypass security, scrape private areas, impersonate others, or use the service for spam.
• We may preserve evidence, quarantine or remove content, issue strikes, suspend profiles or accounts, revoke sessions, or terminate access when content violates these terms or creates legal, operational, reputational, or safety risk.

Accounts and access

• You are responsible for keeping login information secure and for activity under your account.
• Creating an account through the sign-up form records your affirmative acceptance of the version of these terms and your acknowledgment of the Privacy Policy shown at that time.
• Internal admin access is only for authorized Gibbor personnel or approved operators.
• We may change, limit, suspend, or discontinue features as the product evolves.

What you get with a card

• Gibbor Connect is currently sold as a one-time product. There is no subscription required to use your card or your hosted profile.
• The profile connected to a purchased card remains available as part of the product, unless the account, card, or profile violates these terms or the service is discontinued.

Copyright and takedowns

• Copyright owners may submit a notice through our Copyright Policy or contact our published designated agent. We act expeditiously on valid notices and preserve an action history.
• We maintain and reasonably implement a repeat-infringer policy. Three active copyright strikes ordinarily result in account suspension, although we may act sooner in appropriate circumstances.
• Our Copyright Policy explains notices, counter-notices, the 10–14-business-day restoration process, and designated-agent contact details.

Nonconsensual intimate images

• Gibbor Connect prohibits authentic or digitally created intimate depictions published without the depicted person's consent.
• A depicted person or authorized representative may use our Safety Removal process without creating an account. We remove depictions covered by a valid request and make reasonable efforts to remove known identical copies within the period required by law.
• We may preserve limited evidence, cooperate with lawful investigations, and immediately suspend or terminate accounts associated with sexual exploitation or other severe abuse.

Third-party links and services

• Profiles may link to third-party websites, payment pages, booking tools, social networks, maps, menus, files, or forms.
• Third-party names, logos, and icons remain the property of their respective owners. Their appearance is used only to identify a destination or integration and does not imply sponsorship, endorsement, or affiliation with Gibbor Connect.
• We are not responsible for third-party services, their content, their availability, or their privacy and security practices.

Indemnity

• To the fullest extent allowed by law, you will defend, indemnify, and hold harmless Gibbor Technologies LLC and its affiliates, officers, directors, employees, contractors, and service providers from claims, damages, losses, liabilities, judgments, settlements, penalties, costs, and reasonable legal fees arising from content you provide, your misuse of the service, your breach of these terms, or your infringement of another person's rights.
• This section does not limit consumer rights that cannot be waived under applicable law.

Disclaimers and limitation of liability

• The service is provided as-is and as-available. We do not guarantee uninterrupted availability, error-free operation, universal NFC compatibility, or that every phone will behave the same way.
• To the fullest extent allowed by law, Gibbor Technologies LLC will not be liable for indirect, incidental, consequential, special, punitive, or lost-profit damages arising from use of the service.
• Nothing in these terms limits rights that cannot be limited under applicable law.

Governing law and disputes

• These terms are governed by the laws of the State of Minnesota and the applicable laws of the United States, without regard to conflict-of-law rules.
• Any dispute relating to these terms or the service will be subject to the exclusive jurisdiction of the state and federal courts located in Minnesota, except where applicable law gives you the right to bring a claim elsewhere.
• If you are a consumer in Canada or another region, nothing in this section removes any mandatory consumer protection right you have under the law of your place of residence.

Changes

• We may update these terms as the product, laws, or business model changes.
• The updated terms will be posted on this page with a new last-updated date.
